The customer (hereinafter referred to as “you”) can choose between different subscription models (hereinafter referred to as “Subscription”) to use the Netilion Connect service (hereinafter referred to as “Netilion Connect”). These are described in more detail on the Endress+Hauser homepage or in a quotation available to you. By (1) clicking a box or button indicating acceptance, (2) placing an order pursuant to a quotation referring to this Definition of Service, you agree to the conditions defined in this document (“API Terms”). Using the Netilion Platform is required in order to use Netilion Connect. Therefore, the terms and conditions set forth in the Endress+Hauser Master Service Agreement (hereinafter referred to as “Master Service Agreement”) apply in addition and have to be accepted by you in the event of option (1) above prior to completing your order and in the event of option (2) above upon conclusion of the contract.
Netilion Connect enables you by using the Endress+Hauser Netilion API (hereinafter referred to as “API”) to connect, program, and automate certain functions of the Netilion Services. It enables the users to connect to other software or create applications on top of the Netilion Platform. The detailed API functions, calls, and syntaxes are available on the Netilion developer Portal: https://developer.netilion.endress.com.
The usage of the Service requires your registration. In addition to the registration information defined in the Master Service Agreement, the usage of the API requires the user to generate and use API keys. The access to API key is restricted to users with an active and valid API usage plan.
When providing your Application by utilizing the API to your user (hereinafter referred to as “End User”) you shall ensure that the Application is provided in a appropriate frame. You shall implement measures for the End Users that comply with your legal obligations towards the End User, Endress+Hauser standards and your own contractual obligations towards Endress+Hauser, including but not limited to the following:
To protect the functionality of the API and Endress+Hauser against 3rd Party Claims you and your Application shall not:

In having the possibility to access End User content through the API you shall be subject to the following restrictions regarding the misuse of the content, information about End Users using the service and Endress+Hauser as company and trademark. You shall not:
By using the API, you shall be subject to the restrictions provided in Addendum 3 (Acceptable Use) of the Master Service Agreement.
You are entitled to use Netilion Connect in accordance with your Subscription.
You shall use commercially reasonable efforts to protect End User information collected via the API, including personally identifiable information, from unauthorized access or use and shall promptly report the End Users any unauthorized access or use of such information to the extent required by applicable law.
You agree to take appropriate security measures, for example the use of firewalls, virus scanners, etc.; to hold the API free from harm and prevent damage or cutbacks to the API itself, End User content or other users utilizing the API.
Endress+Hauser may limit the maximum user content that may be accessed, the rate at which such user content may be accessed and/or the number of network calls that your application may make via the API. Endress+Hauser may change such usage limits at any time, and/or may utilize technical measures to prevent over-usage and/or stop usage of the API by an application after any usage limitations are exceeded.
Endress+Hauser is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the API which Endress+Hauser provides may be subject to minor changes from time to time without prior notice to you. In the event of incompatible changes, a new version of the API will be provided whilst further providing the old version of the API for at least one year. During this period the outdated version will receive just maintenance and bug fixing updates.
